Keywords & Introduction

Hello, thanks for taking the time to read the terms and conditions. I, Robert Wood (“I”, “Me”, “Robert Wood”) have spent a long time developing Sprout (“Sprout App”, the app”, “Service”) and hope you enjoy the benefits of sharing and creating posts, (“Posts”, “Content”).

 

General

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of my app or trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself and all the trade marks, copyright, database rights and other intellectual property rights related to it, belong to Robert Wood.

Robert Wood is committed to ensuring that the app is as useful and efficient as possible. For that reason, I reserve the right to make changes to the app or to charge for its services, at any time and for any reason.

 

Usage

The Sprout app stores and processes personal data that you have provide to me. It’s your responsibility to keep your phone and access to the app secure. I therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Sprout app won’t work properly or at all.

You should be aware that there are certain things that Robert Wood will not take responsibility for. The app requires you to have an active internet connection most of the time in order to update and load new content, with exception of saved posts (which requires an additional in app purchase). The connection can be Wi-Fi, or provided by your mobile network provider, but Robert Wood cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, I cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, I cannot accept responsibility.

 

Responsibility

With respect to my responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although I endeavour to ensure that it is updated and correct at all times, I do rely on third parties to provide information. I accept no liability for any loss, direct or indirect that you experience as a result of using Sprout.

At some point, I may wish to update the app. You promise to always accept updates to the application when offered to you in order to keep the platform safe and secure. I may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless I tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

 

 

User Generated Content & Usernames

When creating content for the app you must ensure that your post does not violate any of the following rules.

Content includes creating & editing posts, writing comments, creating and updating your username and the images you select for your profile picture and cover image for posts.

Infringe on any applicable law or use copyrighted materials of any kind. Content must not be abusive, pornograghic, threating, obscene, defamatory in nature. Must not include personal information, e.g. (passwords, bank accounts details, email addresses). Impersonating another user’s identity. Creating a post with the sole purpose of advertising your product or services, competitions and so on. Spamming the app with images, texts, links etc. Creating multiple copies of the same post or copies with only minor changes. (If you want to makes alterations to your post, please edit and update your post). Post links to site with malicious content such as viruses, malware, adware etc.

 

Violations

If any of your posts violate the rules for posting. I may remove the offending content as well as delete or deactivate your account. This will be done without any advanced warning.

 

Accountability

Sprout is intended as a place where people of all abilities can share their experiences and knowledge. It’s up to you what you do with that information. I am not responsible for any decisions you make based on what you read or see on Sprout.

 

Distributing the service

You agree not to disrupt Sprout or make it difficult for others to use Sprout as a result of your actions, e.g. manipulate the voting system. Any persons found doing this will have their account deleted.

 

Age restriction

You must be 13+ in order to sign up for and use Sprout. Any persons found using this service under the age restriction will have their account deleted or deactivated.

 

Copyright Violations

I will remove any post on the app that contains copyrighted material if brought to my attention. You can report any post using the “Contact” button. Please provide the following information.

 

  • Your name, address, phone number, email address
  • The location (URL) of the content that you claim to be infringing on your copyright
  • An electronic or digital signature of the owner of the copyright or the persons(s) authorized to to act on the copyright owners behalf.

 

Finally send the email and I attempt to review, repond and take appropriate action, usually within 48 hours. Actions can include any of the following, deleting the users post, suspending the users account. However if I feel I do not have the necessary information to make an informed decision I may request more information from either you or the user who created the post.

 

 

Intellectual Property

Sprout does not claim any ownerships right over the content that you post to Sprout. Whilst the content you publish to Sprout remain yours, Sprout requires a Worldwide license in order to host, distribute your post(s). Additionally in order to showcase what Sprout has to offer we may make alterations to your post, (again solely for the purpose of showcasing your work and if you are featured I will be sure to attribute you).  By agreeing to these terms and conditions you are granting Sprout a Worldwide license.

 

Changes to This Terms and Conditions

I may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. I will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.
